THE PLANNING COMMISSION IS TO REVIEW AND TAKE ACTION, UH, CONCERNING APPROVAL OF MAJOR SITE PLANS.

AND IT IS ALSO BEFORE YOU, BECAUSE THIS PROPERTY IS LOCATED IN THE ENTRANCE OR THE DISTRICT.

AND SO THE PLANNING COMMISSION IS ALSO A REVIEWING AUTHORITY IN TERMS OF APPEARANCE AND ARCHITECTURE OF STRUCTURES AND OTHER DEVELOPMENT OCCURRING WITHIN THAT.

THE PROPERTY LOCATION IS SEVEN OH EIGHT AND SEVEN 12 SOUTH ROYAL AVENUE.

THIS IS RIGHT AT THE INTERSECTION OF ROYAL AVENUE AND OF ROAD.

UH, YOU MAY ALL KNOW IT, UH, AS THE FORMER JOE'S STEAKHOUSE PROPERTY.

UH, THIS PROPERTY IS BEING PROPOSED FOR REDEVELOPMENT AS AN AUTOMOBILE SERVICE STATION USE WITH SIX MULTI-PRODUCT DISPENSERS, UH, CANOPY, UH, ASSOCIATED WITH THIS WILL BE A RETAIL CONVENIENCE STORE AND ALSO A RESTAURANT OR, OR FOOD SERVICE USE, UH, IN THE EXISTING BUILDING.

AND THEY, UH, THE RETAIL AND THE CONVENIENCE, UH, PORTION WILL, WILL TAKE PLACE.

PART OF THE EXISTING, UH, STRUCTURE IS GOING TO BE DEMOLISHED TO MAKE WAY FOR A 2000 SQUARE FOOT ADDITION, UH, FOR THE CONVENIENCE

UH, YOU ALSO HAVE BUILDING RENDERINGS, UH, WHICH SHOW THE BOAT, THE RENOVATED EXISTING BUILDING, WHICH WILL BE THE NORTHERN PORTION, UH, AS WELL AS THE NEW CONSTRUCTION, UH, AS MENTIONED PREVIOUSLY WILL BE FOR THE CONVENIENCE STORE.

THE, UH, THE APPLICANT IN THIS CASE SAYS DOUBLE DELIBERATELY TRIED TO RETAIN SOME OF THE ARCHITECTURE AND THE STYLE THAT HAS BEEN THERE WITH THE EXISTING BUILDING, UH, BECAUSE IT IS LOCATED IN THE, UH, IN THE EASTERN DISTRICT.

AND THIS IS AN ATTEMPT OF, OF THE APPLICANT TO TRY TO RETAIN SOME OF THE, YOU KNOW, THE MORE DISTINCTIVE OR UNIQUE LOOKING, UH, ARCHITECTURAL FEATURES THAT, AND THAT COURT, OR, UH, ALSO YOU CAN SEE, UM, THERE'S RENDERINGS OF THE NEW STRUCTURE, WHICH WILL BE, UM, SHOWS YOU BOTH W W THE WEST ELEVATION FROM SOUTH AVENUE, AS WELL AS THE, UH, THE EAST ELEVATION FROM, FROM KRIZER ROAD, UH, IN TERMS OF SUMMARY AND REVIEW OF COMMENTS.

UH, THIS PROPERTY IS, UM, C1.

THEY'VE BEEN, UM, VERY PROACTIVE AND VERY COOPERATIVE AND RECEPTIVE TO, UH, STAFF'S IDEAS AND RECOMMENDATIONS CONCERNING THE SITE PLAN IN TERMS OF REVIEW COMMENTS, UH, THERE WAS NONE FROM THE TOWN ENERGY SERVICES, UH, THE TOWN PUBLIC WORKS DEPARTMENT.

UH, THEY HAD SOME COMMENTS IN TERMS OF THE, THE FEE FOR THE, FOR THE WATER SERVICE AND THE RIGHT OF WAY UTILIZATION.

UH, ONE THING THAT THAT WILL OCCUR IF YOU LOOK AT THE SITE PLAN, THERE, THERE ARE CURRENTLY THREE ENTRANCES, UH, ON ROWE AVENUE AS PART OF THE REDEVELOPMENT OF THE PROPERTY THAT WILL NOW BE LIMITED TO ONE HAND TRENDS, UH, WHICH, WHICH WILL BE THE, THE PART OF THIS PROBLEM, THE INTERSECTION, WHICH STAFF FINDS VERY FAVORABLE, UH, MAKES, UH, AN, OUR OPINION OF A TRAFFIC SAFETY IMPROVEMENT AND THE REDEVELOPMENT OF THE SITE IN TERMS OF THE PLANNING AND ZONING, THE, UH, REVIEW THE APPLICANT WILL OBVIOUSLY BE REQUIRED TO SECURE ALL NECESSARY, BUILDING PERMITS AND ALL NECESSARY APPROVALS TO WARREN COUNTY HEALTH DEPARTMENT.

UH, ALL OF THIS, UH, WILL NEED TO BE DONE IN TERMS OF ISSUANCE OF CEO, AND BY, BY BOTH THE, UH, THE BUILDING INSPECTION AND A FINAL APPROVAL FROM THE HEALTH DEPARTMENT, ESPECIALLY PERTAINING TO THE, UH, THE RESTAURANT USE ADDITIONAL LANDSCAPING.

UH, THIS IS STILL NEEDS TO BE INCLUDED TOO, TO IMPROVE, UH, WHATSAPP FEELS THE APPEARANCE OF THE PROPERTY IN THE ENTRANCE COURT, OR, UH, AND THAT WOULD BE SOME, SOME STREETSCAPING ALONG THE SOUTH ROYAL AVENUE, UH, HERE, YOU KNOW, WE'RE NOT LOOKING AT A BUFFERING TYPE SITUATION.

WE WILL BE WORKING WITH THE APPLICANT TO TRY TO DEVELOP SOME TREE AND SOME SHRUB PLANTINGS, UH, NOT MEANT TO BUFFER, BUT, BUT MEANT TO, UH, IMPROVE THE AESTHETIC VALUE TO COME WITH A, UH, A FINAL SITE PLAN FOR, FOR THAT DEVELOPMENT, UH, THE EXISTING LANDSCAPING ALONG THE NORTHWEST PORTION, OR THE, UM, THE MORE ROUNDED PORTION, UH, BUILDING ON THE NORTH.

UH, WE'RE LOOKING TO TRY TO HAVE THE APPLICANT PRESERVE THAT EXISTING VEGETATION, AS BEST AS POSSIBLE AS PART OF THAT PLAN.

UH, THE SEPARATE SIGN PERMIT WILL BE REQUIRED FOR ANY NEW SIGNS, UH, THAT WILL BE PROPOSED WITH THIS DEVELOPMENT.

WE ALSO, UH, NEED TO WORK OUT JUST SOME MINOR DETAILS ON THE LIGHTING PLAN, UM, FOR THIS SITE, JUST TO MAKE SURE THAT WE HAVE CUT OFF FIXED YEARS AND, AND OTHER THINGS THAT WILL PROMOTE THE, UH, THE, THE DARK SKY, UH, EFFECT AND NOT CREATE ANY TYPE OF LIGHT POLLUTION OR GLARE TO, UH, ADJOINING USES.

AND WE'LL BE WORKING THERE.

THERE'S A PARKING SPACE.

UM, IF YOU NOTICED IT ON YOUR, ON YOUR SITE PLAN TOWARDS THE, UH, BACK BEHIND THE BUILDING NEAR THE DUMPSTER THAT WE THINK PROBABLY HAS SOME ACCESS ISSUES, AND WE'LL JUST HAVE THAT RESOLVED ON THE SITE PLAN, EITHER MODIFY THAT AREA TO MAKE SURE THAT THE CAR CAN PROPERLY USE THAT SITE AS MENTIONED BEFORE, THIS IS A USE PERMITTED BY RIGHT.

THE PLANNING COMMISSION IS DELEGATED AS THE REVIEWING AUTHORITY FOR THE SITE

PLAN, AND YOU CAN MAKE THAT APPROVAL OR MAKE THAT APPROVAL, UH, WITH CERTAIN CONDITIONS, ANY CONDITIONS THAT THE COMMISSION WISHES TO BE PART OF THAT APPROVAL.

UH, I'LL BE MORE THAN GLAD TO INCORPORATE AS PART OF THE ZONING PERMIT APPROVAL.

THE SITE PLANS ARE GOOD FOR A PERIOD OF NOT FIVE OF NOT LESS THAN FIVE YEARS.

UM, WE DO FIND THAT THE SITE PLAN, UH, YOU KNOW, WE WOULD DETERMINE IT INCOMPLETE, BUT THE INCOMPLETENESS IS MINOR AND JUST WORKING THROUGH SOME FINE, FINE DETAILS WITH, PARTICULARLY WITH THE LANDSCAPING AND THE SIGNAGE AND STAFF WOULD RECOMMEND, UH, CONDITIONING IF THOSE, UH, THOSE TWO FINAL PLANS, UH, STAFF FINES OF OTHER TERMS OF THE ORDINANCE, UH, ARE BEING MET AND WOULD RECOMMEND FAVORABLE ACTION ON THE MAJOR SITE PLAN BY THIS COMMISSION.

UH, BRAEDEN LANE IS DIFFERENT FROM BEING THE LANE ON THIS AERIAL MAP ARC MAP.

UM, WHEN I FIRST LOOKED AT THAT MY HEART LEAPED UP, BECAUSE IT LOOKED, IT LOOKED AS IF THIS IS PLANNING TO MAKE BEATEN LANE COMMON TO ROYAL AVENUE, BUT THEN ON THE SITE PLAN, THERE'S NO SUCH INDICATION.

SO I JUST WANT TO CLARIFY THAT IF I MAY, YOU COULDN'T UNDERSTAND ME, HOLY COW, LET ME TRY THAT AGAIN.

SORRY, FOLKS.

UM, BEING LANE ON THE SITE PLAN, IT'S MISSPELLED AS BRAEDEN, AND IT'S ALSO SHOWN ON ITS ACTUAL CURRENT LAYOUT, BUT THIS MAP, THE AERIAL MAP, UH, INDICATES THAT IT'S CONNECTING NOW WITH SOUTH ROYAL.

AND, UH, THAT WOULD BE, UH, A VERY NICE DEVELOPMENT MAYBE FOR SOME WHO LIVED THERE, BUT I JUST WANTED TO CHECK AND SEE IS THAT IN FACT, ACCURATE, THAT BEATEN LANE IS GOING TO BE CONNECTING TO ROYAL AVENUE.

THAT THAT IS NOT PART OF THIS PROPOSAL.

I DIDN'T THINK SO, BUT I JUST WANTED TO MAKE SURE BECAUSE THAT WOULD BE A VERY LARGE ISSUE.

IS THAT GOING TO BE THAT RIGHT AWAY TO ACCESS THE VENDING MACHINE ICE VENDING MACHINE? IS THAT SOMETHING THAT'S GOING TO BE HONORED OR IS THAT IN, HAS THAT BEEN ADDRESSED IS, IS, ARE JUST SO I UNDERSTAND THE QUESTION CORRECTLY.

ARE YOU TALKING ABOUT RIGHT AWAY OR WAS THERE AN EASEMENT AGREEMENT? I DON'T KNOW.

WE'RE NOT AWARE OF AN AGREEMENT BETWEEN THE, UM, YOU'RE, YOU'RE TALKING ABOUT THE OWNER OF THE ICE HOUSE ICE EQUIPMENT.

NO, IT DIDN'T JUST APPEAR TO BE LIKE THIS INNER PARTIAL CONNECTOR.

AND, UH, I DON'T KNOW IF IT SAID A DEED.

I GUESS THERE'S THREE FRONT ENTRANCES OFF SOUTH ROYAL AVENUE WITH THAT.

IT SEEMED LIKE BECAUSE THERE WERE SO MANY, IT WOULDN'T BE AN ISSUE.

THE ICE HOUSE IS A FAIRLY RECENT DEVELOPMENT.

IS THERE ANY STACKING, UH, SUBMITTED OR THERE ANY, ANY STACKING OF THE CARS FOR THEIR USE OF THE PLACE, BUT THEY DON'T HAVE ANY PARKING.

THERE DID HAVE SOME GOOD HAVE SOME PLANNING WE'LL TALK ABOUT THAT.

AND WHATEVER WE TALKED ABOUT, IT WAS DEEMED SATISFACTORY.

I WOULD BE INTERESTED TO KNOW IF WE CAN DO SOME RESEARCH ON THAT TO FIND OUT EXACTLY WHAT THAT AGREEMENT WAS, IF IT WAS FORMAL OR INFORMAL, UM, AND WHAT THE IMPACT WOULD BE ON THAT VENDOR.

SO IF THAT'S IN WRITING SOMEPLACE, THEY'LL MEET TO HAP SHOW THAT AND MAKE SURE THAT THEY COORDINATE WITH YOU OR WITH THE DRUMMER.

CAUSE WE DON'T WANT TO END UP WITH HIM NOT BEING ABLE TO HAVE CUSTOMERS COME TO THE ICE HOUSE.

AND, UH, I'M JUST WONDERING IF, UH, IF YOU HAVE HAD DISCUSSIONS WITH THE APARTMENT OWNER, OUR BUILDING AND JUST, UH, UH, IF YOU ARE PLANNING TO, UM, UH, THIS ALLOW PEOPLE TO PARK, UH, THAT WOULD BE PARTLY, MOSTLY ON YOUR PROPERTY A LITTLE BIT ON THE, UM, APARTMENTS THEMSELVES.
