MY NAME IS MEGAN MCDONALD AND I LIVE AT 10 22 BRAXTON ROAD.

I PURCHASED THE HOME IN 2024.

I'M SPEAKING TONIGHT BECAUSE I'M TRYING TO GET GUIDANCE REGARDING A LONGSTANDING RETAINING WALL CONDITION.

BUDDING UP TO MY PROPERTY THAT SITS WITHIN A FIVE FOOT STRIP THAT WAS RECENTLY IDENTIFIED BY THE TOWN AS DEDICATED TO THE TOWN, UM, FOR UTILITY ACCESS.

PUBLIC WORKS WAS VERY HELPFUL IN COMMISSIONING A SURVEY AND HELPING DETERMINE THE LOCATION OF THE PROPERTY CORNERS AND THE EASEMENT.

THROUGH THAT REVIEW, IT APPEARS THAT THE RETAINING WALL ALONGSIDE MY DRIVEWAY IS LOCATED WITHIN A STRIP THAT APPEARS DEDICATED TO THE TOWN RATHER THAN ON MY PROPERTY OR MY NEIGHBOR'S PROPERTY.

FOLLOWING THAT REVIEW, I WAS REFERRED TO PLANNING AND ZONING TO BETTER UNDERSTAND WHAT OPTIONS FOR REPAIR MAY EXIST MOVING FORWARD.

I REACHED OUT A FEW TIMES SINCE EARLY APRIL.

I'M STILL WAITING ON GUIDANCE, BUT MY REASON FOR COMING HERE TONIGHT IS TO DRAW ATTENTION TO SOME SAFETY CONCERNS AS WELL AS LAND STABILIZATION CONCERNS.

THE WALL SUPPORTS AN ELEVATED PORTION OF MY DRIVEWAY AND MY PROPERTY, AND THERE'S ABOUT A FIVE FOOT DROP DOWN TO MY NEIGHBOR'S PROPERTY.

THERE'S AN EXPOSED LEDGE ON THE SIDE OF MY DRIVEWAY THAT IS WHERE THAT DROP HAPPENS.

UH, I UNDERSTAND THE TOWN'S CONCERNS ABOUT STRUCTURES IN THE EASEMENT, WHICH IS WHAT PUBLIC WORKS, UM, SAID, BUT I'M ALSO TRYING TO UNDERSTAND WHAT SAFEGUARDS WOULD BE CONSIDERED APPROPRIATE GIVEN THE GRADE CHANGE AND ALSO THE LONGSTANDING RETAINED CONDI CONDITION THAT SUPPORTS MY PROPERTY AND ALSO BY, BY EFFECT MY NEIGHBORS.

UH, ADDITIONALLY, PRIOR TO LEARNING OF THE POTENTIAL TOWN INTEREST IN THE CORRIDOR, I HAD CONTRACTORS LOOK AT THE CONDITION, BUT THEY WERE HESITANT TO ADVISE WITHOUT CLARITY.

REGARDING THE CORRIDOR, THE PLACEMENT OF THE PIPE UNDERGROUND, IT'S ABOUT 16 INCHES, UM, UNDERGROUND, ONE CONTRACTOR PROBED.

UM, UM, AND WHAT CAN OR CANNOT BE DONE THERE.

QUESTIONS WERE RAISED ABOUT THE FUNCTIONALITY OF THE WALL RELATIVE TO THE PIPE.

THE THE WALL EXTENDS FROM THE FRONT OF MY DRIVEWAY ALL THE WAY BACK THROUGH THE BACKYARD WHERE THERE'S NOT AS MUCH ELEVATION, BUT IT IS STILL HOLDING BACK.

IT LOOKS LIKE LAND.

UH, MY GOLDEN NIGHT IS TO CONTINUE TO RAISE CONCERN ABOUT THIS WALL BEFORE THE CONDITION WORSENS.

IT'S ALREADY DETERIORATED THROUGH THE WINTER WITH A CRACK IN MY DRIVEWAY BECOMING EVEN MORE PRONOUNCED.

THE TIMBERS ARE IN SERIOUS DECAY.

SOME ARE MISSING, MAKING THE ENTIRE WALL MORE VULNERABLE TO MOISTURE.

I HAVE PICTURES OF THE CONDITION IF ANYONE WANTS TO LOOK AT THEM.

AND PUBLIC WORKS HAS ALSO VISITED THE SITE AND SEEN THE CONDITION.

I WANNA WORK OPERATIVELY WITH THE TOWN TO PRESERVE ACCESS NEEDS WHILE ALSO ADDRESSING THIS LONGSTANDING CONDITION AFFECTING THE STABILITY OF MY PROPERTY, THE SAFETY OF MYSELF AND OTHERS ON THE PROPERTY AND

THE COMPREHENSIVE UPDATE IS INTENDED TO MODERNIZE STANDARDS CONTAINED WITHIN AND BRING THE LANGUAGE AND COMPLIANCE WITH STATE CODE.

AND IS THERE, IS THERE ANY PRESENTATION OR ANYTHING YOU'D LIKE TO DO OR SAY? SAY THAT ONE MORE TIME.

AND THEN THE OTHER BIG CHANGE WAS CHANGING THAT LANGUAGE THAT CALLED, UH, FOR SPECIAL EXCEPTIONS, UM, TO THIS ORDINANCE.

IT'S, IT'S AN ADMINISTRATIVE VARIANCE.

IT'S A FORM OF VARIANCE.

IT DOES NOT NEED A PUBLIC HEARING.

SO THAT IS THE MAIN CHANGE.

AND THEN ASKING TOO THAT, UM, TONIGHT THAT YOU MOVE ARTICLE NINE, WHICH IS THE DEFINITIONS UP TO THE FRONT OF THE ORDINANCE JUST FOR EASE OF USE AND CLARITY.

I'LL MAKE THIS IN ORDER TO PROMOTE THE HEALTH AND SAFETY AND GENERAL WELFARE OF THE PUBLIC, I MOVE THE PLANNING COMMISSION FORWARD, A RECOMMENDATION OF APPROVAL TO THE TOWN COUNCIL TO APPROVE THE AMENDED SUBDIVISION LAND DEVELOPMENT ORDINANCE TEXT IN ITS ENTIRETY WITH THE FOLLOWING ADDITION TO ADD NEW LANGUAGE FOR THE 1 4 8 DASH TWO 10 SECTION IN ACCORDANCE WITH SECTION 1 48 DASH TWO 10 B OF THIS CHAPTER, THE APPLICANT MAY SUBMIT A WAIVER APPLICATION TO WAIVE EITHER ONE OR MORE TECHNICAL REQUIREMENTS OF THIS CHAPTER AND RECEIVE ADDITIONAL ADMINISTRATIVE APPROVAL OF THE PLAT OR PLAN FOR THE PLANNING FOLLOWING TYPES OF SUBDIVISION OR LAND DEVELOPMENT ACTIVITIES.

UM, WE OPENED UP 14 NEW CODE ENFORCEMENT

AND WE'VE ISSUED 10 BUSINESS LICENSES IN THE PAST MONTH.

UM, SO WITH THIS SUBDIVISION ORDINANCE MOVING TO TOWN COUNCIL OR RECOMMENDATION MOVING TO TOWN COUNCIL, UM, WE'RE GONNA JUMP RIGHT BACK INTO CHAPTER 1 75 AND KEEP WORKING ON THESE ZONING ORDINANCE.

SO NEXT STEP SHOULD BE THE PERFORMANCE STANDARDS IS WHAT WE'LL FOCUS ON.

SO, SIGNS, FENCES, UH, TRAILERS, ANY, MOST OF OUR SUPPLEMENTAL PROVISIONS.
