AND, UH, IT'S CURRENTLY ZONED R THREE, UH, FOR MULTIFAMILY DWELLINGS LIKE TOWN HOMES AND APARTMENTS, AND, UH, CONSTRUCTED ON A SINGLE LOT.

AND, UH, THIS KIND OF CONFLICTS WITH THE BARR'S MISSION STATEMENT, UM, WHICH IS TO PRESERVE AND PROTECT THE CHARACTER AND THE BEAUTY OF THE HISTORIC DISTRICT.

UM, AND WITH HELP, WITH HELP FROM TOWN STAFF, WE'VE DRAFTED, UM, SOME LANGUAGE TO AMEND THE EXISTING ZONING ORDINANCE, UH, FOR THE RESIDENTIAL PORTION OF THE HISTORIC DISTRICT.

UM, SO AS YOU CAN SEE HERE, THIS IS JUST AN AERIAL MAP OF THE PROPERTY.

UM, IT IS OFF OF HAPPY CREEK ROAD, UH, NEAR LEACH RUN PARKWAY AND IS SURROUNDED BY THE HAPPY CREEK KNOLLS SUBDIVISION.

UM, THAT IS JUST THE VICINITY MAP.

UM, SO BASICALLY THIS REQUEST IS TO REDUCE THE REQUIRED ROAD WIDTH AT OUR SUBDIVISION ORDINANCE FROM 36 FEET CURB TO CURB DOWN TO 29 FEET.

UM, CURRENTLY OUR ORDINANCE DOES REQUIRE THAT LOCAL STREETS, WHICH IS WHAT THE, UM, SUBDIVISION STREETS ARE CALLED, THEY'RE CALLED LOCAL STREETS.

YOU HAVE PRI, YOU'VE GOT COLLECTORS, YOU'VE GOT, UM, UH, PRIMARY ROADS, BUT THIS IS JUST FOR THIS TYPE OF STREET FOR LESS THAN 2000, UM, DAILY TRIPS.

THE REQUIREMENT IS 36 FEET.

UM, VDOT, HOWEVER, THEIR STANDARDS REQUIRE ONLY 25 FEET OF WIDTH FROM CURB TO CURB.

UM, AND THEN, UH, SORRY, 24 FEET, SORRY.

IT'S 24, NOT 25 FEET.

AND THAT DOES ALLOW, THAT'S FOR PARKING ON ONE SIDE, FOR PARKING ON BOTH SIDES OF THE STREET.

IT'S 29 FEET IS THE REQUIREMENT.

SO AS YOU CAN SEE, VDOT STANDARDS ARE LESS THAN THE TOWN STANDARDS.

UM, SO WHAT THE APPLICANT PROPOSED HERE IS THE SUBDIVISION.

I THINK THERE ARE APPROXIMATELY 96 LOTS.

UM, WITH 29 FOOT WIDE ROADS, YOU WOULD STILL HAVE ONE SIDE OF ON STREET PARKING, UM, RAISED, UH, CROSSWALKS, WHICH I REMEMBER, OR WHICH WAS, UM, REQUESTED BY THE CITIZENS.

AT THE AUGUST, UM, 2024 PUBLIC HEARING FOR TOWN COUNCIL, THEY ASKED FOR ADDITIONAL SAFETY MEASURES WE PUT IN PLACE, WHICH THE APPLICANT HAS OBLIGED IN THIS PLAN.

UM, OOPS, IF I CAN GET THIS TO WORK.

OKAY.

SO THIS IS JUST THE CROSS SECTION SHOWING HOW YOU COULD TECHNICALLY HAVE CARS PARKING ON BOTH SIDES OF THE STREET HERE WITH THE 29 FOOT, UM, WIDTH, UH, FOR FIRE EMS SAFETY OR FOR THE WIDTH REQUIREMENT, THAT'S ONLY 18 FEET WOULD BE REQUIRED.

SO THE EXCEEDS THE AMOUNT, UH, THAT THE FIRE TRUCKS WOULD NEED TO GET THROUGH THE SUBDIVISION.

UM, THEN WE GET TO THE CODE CONSIDERATION.

SO WITHIN THE CODE 1 48, 2 11 OF TOWN CODE PERMITS THEM TO APPLY FOR THIS SPECIAL EXCEPTION.

IT GIVES CRITERIA AS TO HOW THE DECISION NEEDS TO BE MADE.

SO BASICALLY TOWN COUNCIL AT, WITH THE RECOMMENDATION OF THE PLANNING COMMISSION CAN APPROVE THIS REDUCTION WHEN IT'S DEMONSTRATED WHEN THESE CRITERIA MET.

SO ONE OF 'EM IS THAT WHEN IT'S DEMONSTRATED THAT THE USE OF ALTERNATIVE REGULATIONS FOR A PARTICULAR DEVELOPMENT WOULD BETTER ACHIEVE AT LEAST ONE OF THE GOALS LISTED BELOW, PROVIDED THAT THE SPECIAL EXCEPTION WOULD NOT DIMINISH PUBLIC HEALTH SAFETY OR GENERAL WELFARE, INCLUDING, BUT NOT LIMITED TO CONSIDERATION THAT ADEQUATE PROVISIONS ARE PROVIDED TO ENSURE LONG-TERM MAINTENANCE OF PUBLIC AND SHARED PRIVATE FACILITIES AND CONFORMANCE WITH THE GOALS AND OBJECTIVES OF THE COMPREHENSIVE PLAN.

THE APPLICANT'S APPLICATION DOES MEET THESE STANDARDS.

UM, THE OTHER STANDARDS ARE THAT DESIGN EMPHASIS ON THE PRINCIPLES OF TRADITIONAL NEIGHBORHOOD DESIGN, INCLUDING PEDESTRIAN FRIENDLY ROADS, INTERCONNECTION OF NEW LOCAL STREETS WITH EXISTING LOCAL STREETS AND CONNECTIVITY OF PEDESTRIAN NETWORKS AND MIXED USE NEIGHBORHOODS.

AND THEN CONSERVATION OR USE OF ONSITE NATURAL FEATURES TO PROTECT WATER QUALITY OR OPEN SPACES.

SO THOSE ARE THE CRITERIA AT WHICH THE DECISIONS NEED TO BE MADE.

SO WHEN WE ANALYZE THE APPLICATION, UM, WHEN YOU'RE LOOKING AT PUBLIC HEALTH SAFETY, GENERAL WELFARE, TYPICALLY IN PLANNING LITERATURE AND IN TRANSPORTATION PLANNING AND STUDIES, THEY TEND TO PROMOTE NARROWER STREETS AS A MEANS TO SAFER STREETS.

WE USE THOSE AS TRAFFIC CALMING MEASURES, AND IT'S BECAUSE NARROWER STREETS TEND TO SLOW PEOPLE DOWN.

UM, THEN WHEN WE GET TO CONSIDERATION THAT THE PROVISIONS PROVIDED ARE ADEQUATE TO ENSURE LONG-TERM MAINTENANCE OF PUBLIC AND SHARED PRIVATE FACILITIES.

SO WHILE THE DEVELOPER BEARS THE INITIAL COST OF DEVELOPMENT OF THESE ROADS, THE TOWN THEN ASSUMES MAINTENANCE COSTS FOR THESE IN PERPETUITY AFTER THAT.

SO EVERY 10 TO 15 YEARS, THE TOWN HAS TO COME IN AT THE TAXPAYER AND TOWN EXPENSE AND REPAVE.

SO WE MILL, WE PUT NEW ASPHALT DOWN,

WE PLOW THESE ROADS BY ASKING FOR A SEVEN FOOT REDUCTION IN ROAD WITH, UM, OVER THE COURSE OF 6,000 PLUS LINEAR FEET, WE'RE LOOKING AT ALMOST A REDUCTION OF AN ACRE OF ASPHALT, WHICH IN THE LONG RUN SAVES THE TOWN MONEY.

UM, THE NEXT PORTION OF IT IS THAT DESIGN EMPHASIS OF TRADITIONAL NEIGHBORHOOD DESIGN.

SO THAT'S GOING BACK TO WALKABLE COMMUNITIES, NEIGHBORHOODS WHERE IT'S PEDESTRIAN FRIENDLY, THERE'S INTERCONNECTION WITH NEW LOCAL STREETS.

THAT'S WHAT THIS DEVELOPMENT ACCOMPLISHES.

BY TYING INTO ODIN RIDGE AND HAPPY CREEK ROAD, YOU'RE GETTING INTERCONNECTIVITY BETWEEN LARGE PARCELS OF LAND THAT TENDS TO REDUCE TRAFFIC VOLUME AND BURDEN ON OUR PRIMARY ROADS.

UM, AND THE LAST PIECE OF IT IS THAT CONSERVATION OR USE OF ONSITE NATURAL FEATURES TO PROTECT WATER QUALITY AND OPEN SPACES BY REDUCING THE AMOUNT OF IMPERVIOUS SURFACE BY NARROWING THE ROADS YOU'RE ENLARGING THE, UM, BASICALLY THE GRASSY AREA IS THE LOT SIZE AND THAT ALLOWS FOR ADDITIONAL WATER TO BE ABSORBED IN THE GROUND.

THAT'S LESS WATER, LESS VELOCITY OF STORM WATER GOING INTO OUR SYSTEM.

SO THAT ENDS MY PORTION OF IT.

I'M THE CHIEF DEVELOPMENT OFFICER FOR RAPPAHANNOCK DEVELOPMENT GROUP, WHICH IS THE OWNER AND THE DEVELOPER OF THE PROJECT.

UM, WHEN WE WERE BEFORE THE PLANNING COMMISSION AND TOWN COUNCIL, THERE WERE NUMEROUS CITIZEN COMMENTS, RAISING CONCERNS, PRIMARILY ABOUT TWO ISSUES.

THE FIRST BEING, UM, RUNOFF ON THE SITE AND ISSUES WITH THE EXISTING DEN STREET RUNOFF THAT RAN ALONG THE EDGE OF OUR PROPERTY.

UM, AS WE INVESTIGATED THAT, WE DETERMINED THAT THE CAUSE OF THAT WAS THAT THE BULK OF THE STORM WATER FOR THE SUBDIVISION WAS DRAINING DOWN ODIN STREET TO THE BOTTOM AND THEN DISCHARGED INTO A LARGE DITCH THAT MEANDERED BETWEEN OUR PROPERTY AND THE ODIN RIDGE PROPERTY.

SO THAT WAS ONE OF THE, THE MAIN THINGS IN OUR SITE DESIGN WE WANTED TO ADDRESS.

THE SECOND WAS ABOUT CUT THROUGH TRAFFIC AND PEOPLE DRIVING TOO FAST ON THE STREETS.

THERE WERE COMPLAINTS THAT PEOPLE ARE ALREADY DRIVING TOO FAST ON THE STREETS.

SO AT THE, UM, TOWN COUNCIL MEETING, IT WASN'T IN A REQUIREMENT OF THE REZONING.

WE AGREED THAT WE WOULD WORK WITH STAFF TO COME UP WITH A TRAFFIC CALMING PLAN FOR THE PROJECT TO SLOW DOWN TRAFFIC COMING THROUGH SO THAT PEOPLE WOULD NOT USE IT AS A CUT THROUGH TO CUT FROM HAPPY CREEK ROAD OVER TO THE PARKWAY.

SO THOSE ARE THE KIND OF THE, THE GUIDING PRINCIPLES OF US PREPARING OUR SITE PLAN.

UM, WHEN WE LOOKED INTO THE DIFFERENT TRAFFIC CALLING MEASURES THAT ARE AVAILABLE, THOSE TYPICALLY ARE THINGS LIKE, UH, MAKING THREE OR FOUR WAY STOPS WHEREVER POSSIBLE INSTEAD OF ALLOWING THROUGH STREETS EVERYWHERE SO THAT THE MAIN STREET JUST GOES STRAIGHT THROUGH.

THE OTHER IS FOR PEDESTRIAN SAFETY AS TO RATHER THAN JUST HAVING A REGULAR CROSSWALK PAINTED ON THE GROUND, ACTUALLY HAVE THEM AS KIND OF SPEED TABLES WHERE PEOPLE HAVE TO SLOW DOWN TO GO OVER THOSE.

AND THE NUMBER ONE ITEM LISTED IN MOST HANDBOOKS ABOUT TRAFFIC CALMING IS THE SIZE OF THE ROADWAY.

UM, THERE ARE MANY DIFFERENT KINDS OF SPEEDERS.

UM, I WILL TELL YOU THAT AFTER THE TOWN COUNCIL MEETING, I WAS DRIVING OUT OF TOWN AND I GOT PULLED OVER FOR GOING 38 AND A 25.

AND THE POLICE OFFICER SAID, UM, I UNDERSTAND BECAUSE THIS ROAD LOOKS LIKE IT SHOULD BE, IT GOES MUCH FASTER.

I DUNNO IF IT'S 50.

I, I DON'T KNOW THE NAME OF THE ROAD.

SO I I APPRECIATE THAT, BUT I DIDN'T SEE THE SPEED LIMIT SIGN.

THAT ROAD HAS THE APPEARANCE IN CERTAIN STRETCHES THAT YOU CAN GO FASTER THAN, AND SO MENTALLY.

UM, SO I, I LIKE TO PUT MYSELF IN THAT CATEGORY OF THE, THE UNINFORMED SPEEDER.

UM, BUT THAT'S WHAT HAPPENS WHEN PEOPLE ARE DRIVING ON ROADS, PARTICULARLY STREETS THAT ARE EXTRA WIDE.

THEY HAVE A FEELING THAT IT'S SAFER TO GO HIGHER SPEEDS.

UM, SO, UH, LAUREN ALREADY COVERED SOME OF THIS, BUT THIS IS WHAT A 36 FOOT WIDE ROADWAY WOULD PERMIT PARKING ON BOTH SIDES PLUS THE TRAVEL LANE IN THE, IN THE CENTER.

UM, AS LAUREN MENTIONED, VDOT STANDARD, WHICH YOU DON'T HAVE TO FOLLOW, WE'RE NOT ASKING FOR THE VDOT STANDARD.

WE WANT TO GO HIGHER THAN VDOT STANDARD.

IT WOULD ALLOW A 24 FOOT WIDE ROADWAY.

AND IN MANY JURISDICTIONS THAT WE WORK IN, THAT'S WHAT THE SUBDIVISION STREETS LOOK LIKE, 24 FOOT WIDE WITH PARKING ON ONE SIDE.

UM, TO GIVE YOU AN EXAMPLE OF WHAT THAT LOOKS LIKE, THIS IS THE 36 FOOT WIDE SECTION

OF ODIN STREET, UM, THAT YOU CAN SEE.

AND IT'S AN EXTREMELY WIDE ROADWAY.

AND PART OF THE CHALLENGE WITH THE TWO SUBDIVISIONS NEXT TO US IS THE ROADS ARE VERY LONG, VERY STRAIGHT, AND VERY WIDE.

UH, SO WHEN WE LOOKED AT THAT, WE THOUGHT, WELL, THAT'S CREATES A NUMBER OF PROBLEMS. ONE, UH, IT'S GONNA ENCOURAGE PEOPLE TO GO FASTER, UM, EITHER MENTALLY OR JUST BECAUSE THEY CAN, THEY HAVE THE ROOM.

UM, THE SECOND IS A TREMENDOUS AMOUNT ADDITIONAL RUNOFF THAT'S NOT NECESSARY THAT COULD EXACERBATE EXISTING PROBLEMS WITH DRAINAGE.

UM, HERE'S ANOTHER EXAMPLE.

THIS IS IN, UH, EM, BODEN EMDEN, I'M NOT SURE HOW I PRONOUNCE THAT.

EM BODEN EM, BODEN STREET 36 FEET WIDE IN THIS PARTICULAR SHOT.

THERE'S NO CARS PARKED ON IT, BUT IT WOULD ACCOMMODATE PARKING ON BOTH SIDES.

BUT, UM, THAT WOULD BE A, THAT'S A 36 FOOT WIDE SECTION.

AND YOU CAN SEE THAT ON THIS PLAN, EVEN THOUGH PARKING IS PERMITTED ON BOTH SIDES OF THE ROAD IN THIS AREA TAKEN LESS THAN 5% OF THE ON-STREET PARKING IS BEING USED.

SO IT'S UNUSED PAVEMENT, UH, THAT'S UNNECESSARY.

THAT'S INCREASING RUNOFF AND INCREASING, UH, IMPACTS TO THE ENVIRONMENT.

SO WE DID SUBMIT THIS PLAN WITH OUR PLAN.

THAT'S WHEN WE WERE INFORMED BY THE TOWN THAT THEY WERE NOT PERMITTED WITHOUT A SPECIAL EXCEPTION TO REDUCE THE LANE WIDTHS, WHICH IS WHY WE'RE HERE.

UM, TONIGHT IS TO REQUEST TAKING THE 36 DOWN TO, TO 29.

UM, THIS PLAN SHOWS ALL OF THE THREE-WAY STOPS WE'RE PROPOSING THROUGHOUT THE SITE.

IT ALSO, IF YOU HAVE A LARGER COPY OF IT, SHOWS WHERE OUR CROSSWALKS AND SPEED TABLES ARE, UH, THROUGHOUT THE SITE AND WHERE PARKING IS PERMITTED ON ONE SIDE OF THE STREET.

UM, AND THIS IS THE 29 FOOT SECTION.

WHEN IT, UM, JUST AN EXAMPLE, THIS IS A, UH, IN SPOTSYLVANIA COUNTY, THIS IS A 25, UH, A ROADWAY WITH A 29 FOOT ROAD SECTION WITH PARKING ON ONE SIDE.

SAME THING.

UM, THE WIDER ROADS TYPICALLY MEAN HIGHER VEHICLE SPEEDS, INCREASED STORM WATER, UM, STEEPER YARDS BECAUSE AS YOU MAKE THAT ROAD WIDER, YOU HAVE TO TRANSITION THE GRADE ACROSS THE SITE THROUGH YARDS AND AT THE PERIMETER.

SO YOU END UP WITH STEEPER SLOPES AND MORE RETAINING WALLS, UM, SMALLER YARDS AND OPEN SPACE, AND

THEN THE HIGHER FUTURE MAINTENANCE COST TO THE TOWN.

UM, THE EXCEPTION WITH THE 29 FEET DOES THE OPPOSITE.

THEY RIDE THEIR BIKES DOWN THE SIDEWALK.

IT ONLY TAKES ONE MISHAP FOR SOMEONE TO LOSE CONTROL AND POP A SIDEWALK, AND THEN THERE'S A CATASTROPHE.

AND WHAT HAPPENS IF IT WAS YOUR KID? WOULD YOU CONSIDER THE SAME? YOU'RE GONNA GO FROM A 36 FOOT WIDE STREET WHERE THERE'S KNOWN SPEEDING ISSUES WHERE THE COPS DO SIT SOMETIMES AND TAKE RADAR, BUT WE'RE NOT GONNA ADDRESS THAT ISSUE.
