LAUREN, I HAVE PLACED, SORRY, LET ME GET THIS FOR ME. I'VE PLACED A, UM, AN UPDATED ORDINANCE AT YOUR SEATS TONIGHT. SO THIS IS THE OFFICIAL, UH, ORDINANCE THAT PLANNING COMMISSION RECOMMENDED AT THEIR REGULAR MEETING. [00:05:01] LAST WEEK. THE ONLY CHANGES THAT THEY REQUESTED WERE THAT THE DEFINITION OF SHORT-TERM RENTAL OWNER BE REMOVED. AND THEN THERE'S AN ADDITION OF A ITEM, OH, WHICH WOULD REQUIRE THAT A PROPERTY USED FOR SHORT TERM RENTAL FACILITY IN THE R ONE DISTRICT NEEDS TO BE THEIR PRIMARY OR THEIR PRINCIPAL RESIDENCE. AND THOSE ARE THE ONLY CHANGES BEFORE YOU. UM, AND IN MY UNDERSTANDING, THERE'S ALSO A STAFF RECOMMENDATION THAT, THAT YOU WANT TO BRIEF COUNSEL ON THAT. SO THERE'S ANOTHER VERSION WHICH YOU'VE ALREADY SEEN THAT REMOVED THE LANDLINE REQUIREMENT. SO WE ENDED UP EDITING THE ORDINANCE AT THE LAST MEETING. UM, I WOULD MOVE TO TAKE THAT OUT. OKAY. UM, JUST BECAUSE I DON'T THINK THAT'S FAIR TO THE PERSON WHO OWNS THE PROPERTY, YOU'RE LIMITING WHAT THEY CAN DO WITH IT AND HOW THEY CAN MAKE MONEY WITH IT. AND IT'S THE END OF THE DAY THAT OWNER'S NOT GOING TO BE ON THE PROPERTY A GOOD MONTH, DEPENDING ON HOW, IF THEY'RE RUNNING THEIR WHOLE HOUSE RIGHT. OR ROOM, IF THEY'RE RENTING THEIR WHOLE HOUSE, THEY'RE PROBABLY NOT GOING TO ALSO BE THERE WITH THE GUESTS ANYWAYS. SO I DON'T SEE THE NEED FOR THAT. UM, I NEED TO CLOSE. YEAH. OKAY. I WAS ASKING ABOUT THAT. OKAY. NO, IT WASN'T HERE. OKAY. ALL RIGHT. OKAY. IS THERE ANYBODY HERE WOULD LIKE TO SPEAK? ALL RIGHT. WE'LL CLOSE THE PUBLIC HEARING AND OPEN IT UP TO COUNCIL. OH, I JUST LIKE TO SAY, I AGREE COMPLETELY WITH THE COUNCILMAN THOMPSON REGARDING, OH, SEEMS LIKE IT'S KIND OF A DEAL BREAKER. I MEAN, WE HAVE RENTALS IN TOWN RENTALS THAT PEOPLE OWN THAT ARE RENTED OUT. THEY'RE NOT PROPERTIES. I MEAN, THIS IS VERY SIMILAR TO SHORT-TERM RENTALS. NOT, UM, I WOULDN'T CONSIDER IT IN THE CATEGORY OF COMMERCIAL. I MEAN, I GUESS THAT'S A LEGITIMATE CONCERN. WE HAVEN'T HEARD ANY PUBLIC INPUT REGARDING THAT EITHER. SO I'M REALLY INTERESTED IN KNOWING WHAT EXACTLY, IF YOU CAN GET A LITTLE BIT MORE DETAIL ABOUT WHAT THE PLANNING COMMISSION WAS TALKING ABOUT IN REGARDS TO THAT, I CAN CLARIFY A LITTLE BIT, UM, MR. CHAIRMAN MERCHANT STATED THAT, UM, HE DOESN'T MIND THE SHORT-TERM RENTALS IN RESIDENTIAL ZONES, AS LONG AS IT'S OWNER OCCUPIED HOME OCCUPATION, LIKE BED AND BREAKFAST STAR. SO I THINK THAT WAS THE CONCERN IS THAT YOU WOULD HAVE COMPANIES OR CORPORATIONS THAT WOULD COME IN AND BUY UP HOMES AND TOWN TAKING, UM, POTENTIAL PROPERTIES FOR, YOU KNOW, PEOPLE IN FRONT ROYAL OFF THE MARKET AND TO BE USED AS A COMMERCIAL USE. I PRETTY SURE THAT THE STATE RECENTLY, UM, DETERMINED THAT AIRBNBS OR THESE TOURIST HOMES ARE NOT TECHNICALLY CALLED A COMMERCIAL USE. IT'S NOT A, IT'S STILL RESIDENTIAL USE OF THE PROPERTY, BUT THAT'S STILL, I THINK, PENDING IN THE, YEAH, I THINK IT WAS AN UNDERSTANDING IN REGARDS TO THAT IT WAS GOING TO BE A BI-RITE GOING FORWARD UNLESS LOCALITIES HAD SPECIFIED OTHERWISE. BUT I JUST LIKE TO ECHO THE SENTIMENTS OF COUNCILMAN THOMPSON AND COUNSELING, UH, MCFADDEN THAT I THINK IT'S GOING TO REALLY LIMIT AND RESTRICT THE NUMBER OF SHORT-TERM RENTALS WE HAVE, IF THAT HAS TO BE A PRIMARY RESIDENCE, IT KIND OF DEFEATS THE PURPOSE. ALSO THINKS THAT, SORRY. I ALSO THINK THAT SOME OF THE CONCERNS WITH THE PLANNING COMMISSION ARE IRRELEVANT ONLY BECAUSE, UM, EACH OF THESE IS GOING TO COME BEFORE AS A SPECIAL USE PERMIT. SO IF A CORPORATION IS BUYING UP THESE HOUSES, WE'RE GOING TO KNOW WHEN WE PULL THE RECORDS TO SEE WHO OWNS IT. SO I DON'T THINK THAT'S REALLY, UH, A REASON TO PUT, OH, ON HERE. THAT WAS MY POINT GONNA BE, [00:10:01] UM, MS. THOMPSON TOO, IS THAT, UM, IT, IT SEEMS LIKE, UM, A DOUBLE PROTECTION ON THIS BECAUSE ALL THIS IS GOING TO COME BACK THROUGH, UM, THROUGH SPECIAL USE PERMIT. UM, YOU KNOW, SO I TWO, UM, WOULD BE, UM, AGAINST ADDING THAT. SO, UH, I HAD A QUESTION, UM, MR. MAYOR, ABOUT THE, UH, WHY, WHY DID THEY WANT TO TAKE OUT SHORT-TERM RENTAL OWNER? NO, I THINK AT THE END WHERE WE QUOTED THE STATE CODE, I THINK THE SECTION THAT, UM, BROADENED THE DEFINITION MORE. AND SO IT ALLOWED LIKE SUBLESSEES TO REGISTER A SHORT TERM RENTAL. AND I THINK THAT WAS SOME OF THE CONCERN. IT WAS THE DEFINITION STARTED TO CONFLICT, OTHER PARTS OF THE DEFINITION YOU AND I JUST WANTED TO ADD ONE COMMENT AND IT'S REALLY JUST A, A THOUGHT FOR MY COLLEAGUES, A CONSIDERATION. AND THAT IS AS THESE COME UP ON FIRST SPECIAL USE PERMIT. UM, I DON'T KNOW APPLICATIONS AS WE CONSIDER THESE, UH, I, I DO, UH, HAVING, UM, LIVED IN, UH, IN A TOUR TOURIST, UM, I DON'T KNOW, SETTING GROWING UP. I HEARD A TOWN THAT WAS, I MEAN, IT WAS ESSENTIALLY A TOURIST TOWN. THAT'S WHAT WE CALLED IT IN ANY WAY. THE, I, I DID WITNESS A CHANGE, LIKE A GENERATIONAL CHANGE IN THE APPROACH TO PROPERTY OWNERSHIP IN THE TOWN. AND, UM, THIS IS SOMETHING TO WATCH CLOSELY AND KEEP IN MIND. UM, AS, AS WE SEE THIS NEW PHENOMENON ARRIVE ON OUR DOORSTEPS, UH, THE SECTION, OH, DOES RAISE SOMETHING THAT HAS SOME VALIDITY BECAUSE, UM, I MEAN, EVEN, UM, PRIVATE ACTORS, NOT NECESSARILY CORPORATE FORCES, IF YOU WILL, UM, COMING INTO TOWN AND BUYING PROPERTIES THAT THEY HAVE NO INTENTION OF INHABITING OR REALLY BEING ANYWHERE NEAR IF THEY'RE FROM, FROM OUT OF STATE OR EVEN FROM A DISTANT PART OF THE STATE, UM, THAT CAN OVER TIME, UH, THE MORE THEY'RE PRESENT COULD, UH, CHANGE THE FABRIC OF A, OF A COMMUNITY. SO SOMETHING THEY KEEP IN MIND, UM, IS SOMETHING THAT I'VE SEEN. UH, IT'S NOT APPLES TO APPLES OF FROM WHERE I GREW UP TO WHERE, WHERE WE ARE NOW. UM, BUT IN ANY CASE, IT'S JUST SOMETHING TO THINK ABOUT. AND I'M LIKE, JUST COMING ON THAT, THAT, YOU KNOW, ONE OF THE THINGS WE ALREADY EXPERIENCED HERE IN FRONT ROYAL IS, UM, ABSENTEE OWNERS THAT AREN'T, THAT DON'T LIVE IN THE COMMUNITY. AND SO WE OFTEN SEE THAT WITH SOME OF OUR, I DON'T KNOW, GOT WORSE FOR A LACK OF A BETTER WORD RENTAL PROPERTIES. UM, I'M MUCH MORE COMFORTABLE WITH THIS BECAUSE THERE'S A SYSTEM OF REVIEWS AND IF THEY DON'T GET GOOD REVIEWS, SO IT'S AN, I MEAN IN THAT INDUSTRY VERSUS LIKE, I DON'T KNOW IF SOMEBODY'S LIVING IN A RENTAL HOUSE, HOW DO THEY WRITE A REVIEW FOR THAT RENTAL HOUSE? UM, I GUESS MOVE OUT, BUT WITH OUR HOUSING MARKET, THAT'S OFTEN HARD TO FIND A BETTER PLACE OR FIND A DIFFERENT LIVING ACCOMMODATIONS. SO I THINK EVEN IN, IN THE SENSE OF THE SHORT-TERM RENTAL COMPANIES THAT LEASE THEM, THEY DO USUALLY HOLD THE OWNERS TO A STANDARD. SO THAT WOULD ONLY BE MY, MY POINT ON THAT IS THAT HOPEFULLY WE'LL HAVE, UH, EVEN IF WE DO HAVE LOCAL OWNERS BUYING THESE HOUSES TO TURN THEM INTO A SHORT-TERM RENTAL. SO AT LEAST THEY LIVE IN OUR COMMUNITY, WHICH IS GREAT. AND THEN THAT'S INCOME COMING BACK INTO OUR COMMUNITY, BEING, YOU KNOW, COMING IN FROM OUTSIDE AND THEN BEING RE SPENT IN THE COMMUNITY JUST TO ADD TO THAT, SCOTT, I UNDERSTAND AS SOMEBODY WHO WAS BORN AND RAISED HERE, THAT WE DON'T WANT TO CHANGE THE NATURE OF OUR COMMUNITY AND THE SENSE OF COMMUNITY THAT WE HAVE HERE, BUT I ALSO THINK IT'S IMPORTANT TO BE LIMITED GOVERNMENT AND NOT NECESSARILY DICTATE WHO DOES AND DOESN'T BUY THE PROPERTIES VERSUS OCCUPY THEM. BUT I WILL ADD ALSO SHORT-TERM RENTALS IN THE COUNTY ARE RIGHT NOW, WIDELY BEING USED BY LONG-TERM RENTALS FOR PEOPLE THAT ARE WAITING FOR A HOUSE ON THE HOUSING MARKET. UM, I KNOW SOMEBODY WHO'S RENTING AN AIRBNB ON BLUE MOUNTAIN AND THEY'VE HAD THE SAME PEOPLE RENTING IT AT AN AIRBNB COST OVER $3,000 A MONTH, UM, AS A LONG-TERM RENTAL, BECAUSE THERE'S NO, THERE'S ALSO ABOUT TWO RENTALS ON THE PROPERTY AND THE TOWN OF FRONT ROYAL RIGHT NOW. RIGHT. AND JUST TO CLARIFY, I'M NOT SUGGESTING A POLICY CHANGE, I'M JUST NOTING SOMETHING TO KEEP, KEEP IN MIND AS WE SEE. AND I THINK I'M SPEAKING MORE OR LESS TO, UH, YOU KNOW, LIKE A, A BLADED OR UNDER, UM, MAINTAINED PROPERTY SWITCHING INTO A BETTER INTO THE HANDS OF SOMEBODY WHO'S GOING TO MAINTAIN IT BETTER. I'M THINKING MORE LIKE A HOUSE THAT, YOU KNOW, UM, HAS BEEN WITH A FAMILY FOR MANY YEARS. IT GETS SOLD OUT OF THE FAMILY TO SOMEBODY WHO DOESN'T LIVE HERE AND BECOMES A RENTAL PROPERTY. [00:15:01] AND THERE'S NEW PEOPLE IN THERE CYCLING THROUGH. IT JUST HAS AN EFFECT ON A COMMUNITY THAT I WANT US TO KEEP IN MIND, MR. MAYOR, HAVING WATCHED THE, UM, PLANNING COMMISSION MEETING. AND YOU DID A GOOD JOB OF, I THINK, UM, SUMMARIZING SOME OF THEIR CONCERNS. I KNOW OPERATOR WAS DISCUSSED FOR QUITE A WHILE UNTIL THE CODE WAS BROUGHT UP AND THEN ADDING THE OTHER THING, I JUST WANT TO SAY, I CAN RESPECT WHAT SCOTT'S SAYING ONLY BECAUSE OF HAVING SEEN SOME PROPERTIES, MORE RENTAL PROPERTIES WHERE PEOPLE THAT DON'T LIVE NEARBY, BUT AGREED THAT IT IS THEIR PROPERTY. UM, AND I WAS GOING TO SAY TO THE COUNTY IS, HAS A LOT OF SHORT-TERM RENTALS. AND IF I REMEMBER CORRECTLY AT THE LIAISON MEETING IN SEPTEMBER, WHEN WE ASKED THEY HADN'T HAD ANY SHORT RENT, SHORT TERM RENTALS THAT THEY HAD HAD TO, UM, DENY ANY MORE THROUGH, THEY HADN'T HAD ANY PROBLEMS WITH THEM. SO I'M HOPING THAT'S A GOOD SIGN FOR US, LAUREN, THE SHORT TERM RENTALS, UM, WHO WILL BE DOING THE INSPECTION FOR THOSE. THAT WAS PART OF THE, WHAT WE READ IN OUR PACKET. SO THEY WILL BE SUBMITTED, UM, AS PART OF THE APPLICATION. AND THEN AT THIS POINT IN TIME, EITHER CHRIS BROCK OR JOHN, WHERE WE'LL BE DOING AND INSPECTIONS. OKAY. AND THEN THE NEXT QUESTION I HAVE WAS, UM, THERE WAS A $400 FEE, UM, FOR SOMEONE TO APPLY FOR THE SHORT-TERM RENTAL. AND THAT'S A ONE-TIME FEE, CORRECT?
